Withdrawal and Refund Policy

Status: DRAFT — CONSUMER INFORMATION AND EMAIL ORDER PROCESS REVIEW REQUIRED

1. Digital purchases

AnyNC is digital content made available electronically, normally immediately after purchase. Payments are non-refundable except where mandatory law provides a withdrawal, refund, or other remedy, or where the seller expressly agrees otherwise.

2. Fourteen-day consumer withdrawal right

Consumers in the European Union, European Economic Area, and United Kingdom may withdraw from an eligible online purchase within 14 days after completing the transaction, without giving a reason.

Because the software is supplied immediately, the customer may be asked during checkout to:

1. expressly request access before the 14-day period ends; and 2. acknowledge that the withdrawal right is lost when performance begins following that consent.

For German consumer contracts for paid digital content not supplied on a physical medium, early expiry requires prior express consent to performance before the withdrawal period ends, acknowledgement of the resulting loss of the right when performance begins, and the contract confirmation required by section 312f BGB. Sending request.c2v alone does not establish those conditions. AnyNC will not treat downloading or activation alone as a valid waiver. Mandatory local consumer rights always prevail.

3. Direct and reseller purchases

For a direct AnyNC purchase, send an eligible request to anync.software@gmail.com. The request should identify the buyer, order, purchase date, and the clear decision to withdraw. Postal requests may be sent to Igor Ðurica, AnyNC, Hölzleweg 61, 78054 Villingen-Schwenningen, Germany. The model withdrawal form appears below. Use of that form is optional; a clear withdrawal statement by email is sufficient. Purchase details help identify the order but are not an additional condition for a valid withdrawal.

For a purchase from an authorised reseller, contact that reseller. Its quotation, checkout, invoice, and refund process govern the sale, subject to mandatory law. The reseller cannot reduce the customer's rights under the AnyNC software licence or applicable consumer law.

4. Other refunds

Outside an applicable statutory right, AnyNC does not provide refunds after a licence has been delivered or activated unless the order or seller expressly says otherwise. This does not affect remedies for non-delivery, defective digital content, breach of contract, fraud, or any right that cannot lawfully be excluded.

Cancelling a subscription prevents future renewal. It does not normally create a refund for the current billing period unless the seller's terms or applicable law require one.

5. Business customers

Business purchases are final and non-refundable after delivery or activation, unless the quotation, invoice, reseller agreement, or mandatory law states otherwise.

This form does not replace the separate pre-contract withdrawal instructions (Widerrufsbelehrung) or the required contract confirmation. Those must be provided as part of the email sales process.
